(1) Subject to
subregulation (2) the records referred to in regulation 38 with
respect to a prisoner who is released without conviction by a court and of a
prisoner who is acquitted of the charge in respect of which he was imprisoned
shall be destroyed at the request of the prisoner.
(2) The chief
executive officer may, for statistical purposes, retain a record
of —
(a) the
name and date of birth;
(b) the
usual place of residence at the time of admission;
(c) the
date and reason for admission; and
(d) the
date and reason for discharge,
of a prisoner referred
to in subregulation (1).
