The clerk of the Local
Court shall execute a proper conveyance or transfer of the land to the
purchaser which shall convey or transfer to the purchaser (subject to
registration under the Transfer of Land Act 1893 ) an estate in fee
simple in the land, or (if such land has not been alienated from the Crown in
fee simple) all the estate and interest therein of every person (other than
the crown) and all the estate and interest which any such person is entitled
or able to transfer, assign, convey or dispose of therein, and the estate of
the purchaser shall be subject to the exceptions, conditions and powers (if
any) contained in the grant or Crown lease or conditional purchase lease of
the land and to any public rights of way and to any easements acquired by
enjoyment or use or subsisting over and upon or affecting the land, and to any
rates and taxes imposed or to be imposed on or in respect of the land after
the date of the sale, and to any mortgage in favour of the Agricultural Bank,
