For the purposes of
sections 87(3)(b) (Application for variation of registration) and 90
(Variation of conditions and restrictions) of the Law, an application for a
variation of a registration or an application for a variation of a condition
or restriction imposed by the Regulator, must contain —
(a)
details of the scope and nature of the proposed variation; and
(b)
details of the changes that will be made to the applicant’s scheme for
the management of risks to safety associated with the railway operations to be
carried out in the private siding if the proposed variation occurs; and
(c)
details of any consultation that has occurred with the parties who might be
affected by the proposed variation, including —
(i)
who was consulted; and
(ii)
when and how the consultation occurred; and
(iii)
the results of the consultation.
