(1) The Commissioner
of Main Roads may, by notice in writing given to the person to whom a permit
was issued, cancel or suspend an access approval given by the permit
if —
(a) the
access approval was given on the basis of incorrect or misleading information,
whether or not fraud or misrepresentation was involved; or
(b) the
Commissioner has reason to suspect that there are grounds on which the
Commissioner could, if then considering whether to give the access approval,
refuse to give it; or
(c) the
permit has not been complied with.
(2) The Commissioner
of Main Roads may, by order published in the Gazette , cancel or suspend an
access approval given by order if —
(a) the
access approval was given on the basis of incorrect or misleading information,
whether or not fraud or misrepresentation was involved; or
(b) the
Commissioner has reason to suspect that there are grounds on which the
Commissioner could, if then considering whether to give the access approval,
refuse to give it.
(3) Cancellation or
suspension of an access approval under subregulation (1) or (2) does
not affect the liability of a person to any penalty attributable to anything
mentioned in subregulation (1)(a) or (c) or (2)(a).
