(1) Except as provided
in section 5 and subregulation (2), if an application is made for
the grant of a licence —
(a) for
a vehicle not previously licensed under the Act, the CEO must grant a licence
for the vehicle to the applicant for a period mentioned in regulation 31;
or
(b) for
a vehicle for which the licence last granted or renewed under the Act expired
before the period beginning 15 days before the day on which the
application was made, the CEO must grant a licence for the vehicle to the
applicant for a period mentioned in regulation 31.
(2) If —
(a) an
application is made for the grant of a vehicle licence mentioned in
subregulation (1)(b); and
(b) the
application is made within the renewal period under regulation 30 in
relation to the vehicle licence; and
(c) any
number plate issued for the vehicle has not been returned to the CEO,
the CEO may refuse to
grant the licence, in which case the application must be taken to be an
application for a renewal of the licence last granted or renewed for that
vehicle.
