(1) In this
regulation —
permitted launching place means —
(a) a
boat ramp —
(i)
approved under the Swan River Trust Act 1988
1 or the Swan and Canning Rivers Management Act 2006 ; or
(ii)
that was in existence at the commencement of the
Swan River Trust Act 1988 1 , and has not been altered in
contravention of that Act or the Swan and Canning Rivers Management
Act 2006 ,
and that is licensed
to be used under the Jetties Act 1926 section 7; or
(b) an
area that is between 2 signs for the time being erected or established by
authority of the CEO and inscribed with words indicating that the launching of
vessels from trailers is permitted and each having an arrow pointing generally
towards the other sign;
trailer means a vehicle without its own motive
power that is built to be towed, or is towed, by a vehicle.
(2) A person must not,
unless the person has a permit to do so, launch a vessel directly from a
trailer into any waters in the Riverpark or development control area except at
a permitted launching place.
Penalty for this subregulation: a fine of
$5 000.
