(1) An offence under
section 65(1) in respect of a contravention or failure to observe a
provision of the Act specified in Schedule 5 Part 1 is an offence
for which an infringement notice may be issued under Part 2 of the
Criminal Procedure Act 2004 .
(2A) An offence under
section 120(1) in respect of a contravention or failure to comply with a
provision of the Act specified in Schedule 5 Part 2 is an offence
for which an infringement notice may be issued under Part 2 of the
Criminal Procedure Act 2004 .
(2B) An offence under
section 41B of the Act is an offence for which an infringement notice may
be issued under the Criminal Procedure Act 2004 Part 2.
(2) The modified
penalty specified opposite a provision in Schedule 5 is the modified
penalty for a contravention or failure to observe, or comply with, that
provision for the purposes of section 5(3) of the Criminal Procedure
Act 2004 .
(3) The Commissioner
may, in writing, appoint persons or classes of persons to be authorised
officers or approved officers for the purposes of Part 2 of the
Criminal Procedure Act 2004 .
(4) The Commissioner
is to issue to each authorised officer a certificate, badge or identity card
identifying the officer as a person authorised to issue infringement notices.
