(1) A GESB Super
(Retirement Access) Member may request the Board to —
(a) pay
to the Member; or
(b)
transfer to another scheme or to another superannuation fund,
a benefit of an amount
equal to all or part of the balance of the Members retirement access account.
(1A) A request under
subregulation (1)(a) may be made —
(a) in
relation to so much of the Member’s account balance as constitutes an
unrestricted non‑preserved benefit, at any time; or
(b) in
relation to so much of the Member’s account balance as constitutes a
restricted non‑preserved benefit, at any time after the Member has
ceased to be a worker.

(1B) A request under
subregulation (1)(b) may be made at any time.
(2) The Board must
refuse a request for the payment or transfer of an amount that is, or the
payment or transfer of an amount that reduces the balance in the
Member’s retirement access account to, less than the pre‑set
minimum (if any).
(3)
Subregulation (2) does not apply if —
(a) the
amount requested is the whole of the balance in the account; or
(b) the
Board is satisfied it is appropriate to comply with the request because of the
special circumstances of the Member.
