(1) If the Treasurer
considers there are special circumstances the Treasurer may direct the Board
to pay a benefit that is not otherwise payable to —
(a) a
Member; or
(b) a
former Member; or
(c) the
personal representative of a Member or former Member; or
(d) a
person who is not a Member but in respect of whom contributions have been made
as if he or she was a Member; or
(e) a
class of persons each of whom is a person referred to in paragraphs (a)
to (d),
and the Board is to
give effect to that direction.
(2) The cost to the
Fund (if any) of paying a benefit under this regulation is to be assessed by
an actuary and paid to the Fund by the person specified by the Treasurer in
the direction.
(3) When giving a
direction under subregulation (1) the Treasurer may make payment of
the benefit subject to any conditions the Treasurer considers appropriate.
