(1) If a person has
ceased to be entitled to a right, privilege or benefit to which the person
was, or might have been, entitled under the Act and the Board is satisfied
that —
(a) the
cessation was not due to the person’s own fault; and
(b) it
is just and equitable to do so,
the Board
may —
(c)
permit the person to exercise the right; or
(d)
grant the person the privilege; or
(e) pay
the benefit to the person,
even if any relevant
time period prescribed by or under the Act has expired.
(2) For the purposes
of subregulation (1) the Board may make any enquiries it considers
appropriate.
(3) When exercising a
power under subregulation (1) the Board may impose any conditions it
considers appropriate.
