(1) Under a land use
restrictive covenant, the covenantor covenants with the covenantee that the
covenant area may be used only for a use or class of use specified in the
short form documents.
(2) The restrictive
covenant —
(a)
burdens any lot or common property identified on the scheme plan or amendment
of the scheme plan as a lot or common property burdened by the restrictive
covenant; and
(b)
benefits a local government or public authority specified in the short form
documents (and does not benefit a lot or common property).
Note for this regulation:
For example, a land
use restrictive covenant could provide that the covenant area may be used only
for purposes of accommodation for aged and dependant persons or for the
purposes of single bedroom dwellings.
