(1) A person who is
entitled to dispute a determination by a licensed valuer or licensed surveyor
that a stage of subdivision is not a significant variation may dispute whether
that determination is sufficiently accurate to be relied on by a person for
the purposes of section 36.
(2) For the purposes
of section 197(1)(i), the dispute is a scheme dispute between the person
entitled to dispute the determination and the person proposing to make the
application for amendment of the scheme plan.
(3) The time limit for
making an application to the Tribunal for resolution of the dispute is
28 days after notice of the determination is served in accordance with
regulation 50(4)(a).
