Western Australian Current Regulations Western Australian Current Regulations (1) This regulation
applies to regulated e‑waste received by a landfill operator that is
mixed with other waste.
(2) The landfill
operator must separate the regulated e‑waste from the other waste.
Penalty for this subregulation: a fine of
$10 000.
(3) It is a defence to
a charge of an offence under subregulation (2) to prove that the landfill
operator —
(a) took
reasonable steps to avoid the commission of the offence; or
(b) did
not know, and could not reasonably have known, that the regulated
e‑waste was mixed with the other waste.
