(1) A person who is or
has been in a position to which this section applies must not, whether
directly or indirectly, record, disclose, or make use of any information
obtained because of being in that position, except —
(a) for
the purposes of and in the due exercise of functions under this Act;
(b) when
ordered by a court or a judge to do so; or
(c) in
circumstances approved from time to time by the Minister.
Penalty: $2 500.
(2) The positions to
which this section applies are —
(a) a
member, a deputy of a member, an acting member or the secretary of the Board;
(b) the
CEO; and
(c) a
member of the departmental staff.
