THE SENIOR DEPUTY PRESIDENT: Leave is granted, Mr Klemis. Yes, Mr Crampton?

MR CRAMPTON: Thank you, your Honour. We rely upon the submissions in previous matters particularly matter 2001/2389 and hand up a copy of draft order and a sheet which sets out the methodology used to calculate adjustments to allowances.

THE SENIOR DEPUTY PRESIDENT: The draft order will be marked as ALHMWU1 and the calculations as ALHMWU2.

MR CRAMPTON: Your Honour, if I may just point out on the second page of the draft order at paragraph 4, sets out there by deleting from clause 14.1.1, juniors, the amount of $5.60 and substituting in lieu thereof $5.80. As a result of discussions prior to today's hearing we think that that amount should be $5.75.

MR CRAMPTON: Yes, your Honour. If the Commission pleases.

THE SENIOR DEPUTY PRESIDENT: Yes, Ms Whitecross?

MS WHITECROSS: If the Commission pleases, the Victorian Employers Chamber of Commerce and Industry does not oppose the application made by the LHMU in this matter subject to the above amendment on page 2 as highlighted by Mr Crampton. We are also satisfied that it is consistent with the safety net adjustment.

THE SENIOR DEPUTY PRESIDENT: Thank you. Mr O'Brien?

MR O'BRIEN: Yes, thank you, your Honour. Once again we have had the opportunity to review the draft order and have had discussions with the LHMU and we have reached agreement on the particular rates.

MR KLEMIS: Thank you, your Honour, the BIAV supports the union's application, subject to the provision that it is on-going, thank you.

THE SENIOR DEPUTY PRESIDENT: Subject to the Commission being satisfied as to the amounts contained in the draft order as amended an order in the terms of ALHMWU1 as amended will be issued as soon as possible and forwarded to the parties. Before adjourning, can I just thank the representatives of the parties for the cooperative way that these matters have been dealt with and also, Mr Crampton, if the union has these draft orders on disc, a copy of that disc could be supplied to my associate would help us with efficiently disposing of the matters. That matter is adjourned on that basis and the Commission itself is adjourned.
