THE SENIOR DEPUTY PRESIDENT: May I have appearances in Adelaide in this matter?

MR C. STARR: I appear on behalf of Laminex Industries.

MR D. TRENOUTH: I appear on behalf of the National Union Workers.

THE SENIOR DEPUTY PRESIDENT: I have had an opportunity to peruse the statutory declarations lodged in support of the certification of the agreement as well as the agreement and I have no questions of either of you. Mr Starr, do you want to put something on transcript?

MR. STARR: Probably only briefly, Senior Deputy President, that obviously there was numerous meetings between the parties and the developments were consistently reported back to all employees. It contains obviously avoidance of disputes procedure at clause 9 and a no extra claims provision at clause 38. Valid majority accepted it on 26 March 2001 and the parties agreed that it would operated from the date of certification for a period of three years. Nothing more than that, Senior Deputy President.

MR TRENOUTH: No, Senior Deputy President, I will just support the comments made by Mr Starr this morning, thank you.

Based on these statutory declarations lodged and the submissions made, I have formed a view that each of the relevant requirements of the Act have been met and the agreement to be known as the Laminex Industries Adelaide Distribution Agreement 2000, will be certified. It will come into operation on today's date, 1 June 2001 and remain in operation till 1 June 2004. A certificate and brief reasons for decision will issue in due course and a copy will be provided to the parties.
