MR D. PERKINS: I appear on behalf of the CPSU.

MR M. BUTLER: I appear for the Association of Professional Engineers, Scientists and Managers Australia and the Professional Officers Association Victoria.

MR T. VEENENDAAL: I appear for the Australian Liquor, Hospitality and Miscellaneous Workers Union.

MR J. NUCIFORA: I appear for the Australian Services Union.

THE SENIOR DEPUTY PRESIDENT: Yes, I think the only absentee is again the NTEU in this case and their correspondence did indicate that they would not be present for today's hearing, but expected, as I recall, that they anticipated some agreement being reached in the near future. What is the position, Mr Perkins?

MR PERKINS: Your Honour, the organisation has had discussions with the ALHMWU, the NTEU and the ASU. I arranged with Mr Butler to confer with him after the mention today. And I think it would be most appropriate to relist the matter in four weeks time.

THE SENIOR DEPUTY PRESIDENT: Again in Sydney.

MR PERKINS: Yes, your Honour.

THE SENIOR DEPUTY PRESIDENT: Mr Butler.

MR BUTLER: If the Commission pleases, I can confirm that we will be meeting with the CPSU this afternoon and we have no objection for the matter being listed for mention in Sydney, but if it were to go to a full hearing with our participation in it, we might have some submission to make as to the location at some stage in the future.

THE SENIOR DEPUTY PRESIDENT: Thank you. Mr Veenendaal.

MR VEENENDAAL: Thank you, your Honour. There have been some discussions between my organisation and the CPSU which I am instructed is likely will bear some fruit, hopefully in the not too distant future. Therefore, we would support that the matter be adjourned to an appropriate time and place the Commission determines. In respect to the location, again, your Honour, we would support that the matter be listed in Sydney. Thank you, your Honour.

THE SENIOR DEPUTY PRESIDENT: Thank you. Yes, Mr Nucifora.

MR NUCIFORA: Thank you, your Honour. The ASU confirms having had discussions as per the earlier matter earlier on today with the CPSU. The discussions have gone along the same lines that we were seeking to try and reach agreement and clarification of the objectives of the CPSU, and I think we have achieved a certain amount of clarification on that and we would very strongly believe that we can reach agreement.

We do want to have in this case universities we do have direct membership the universities in certain states, particularly in Queensland, and we do want to allow for some obviously internal consultation to occur. We believe we can reach agreement within the time period leading up to 19 March. In relation to the location leading up to 19 March, in relation to the location we would concur with what Mr Butler has put that if there were a need - if we needed further submissions, we may have had a concern about the location, but we are not otherwise opposed to the next hearing being in Sydney. If your Honour pleases.

THE SENIOR DEPUTY PRESIDENT: Thank you. Is there anything else for the record? If not, I will again adjourn this matter until 10.30 am on Monday, 19 March 2001 in Sydney for report and possible programming. I can indicate to the parties of the fact that I have listed the next hearing in Sydney. There is no indication as to the locality of any future hearings should the matter go to the necessity for calling evidence, etcetera, in due course. The matter is adjourned on that basis and the Commission itself is adjourned.
