THE SENIOR DEPUTY PRESIDENT: Any changes to appearances in this matter? If not then, Mr Maxwell, what is the position with that one?

MR MAXWELL: Thank you, your Honour. Your Honour, in regard to the Roof Slaters and Tilers (Victoria) Award, again the parties have met on a couple of occasions in regard to this award and the union has provided a draft of a simplified award. At this stage we are waiting for the employers to get back to us with their comments. Again we are hopeful that we can reach agreement on this award. I think there is a general agreement between the parties that we will follow the outcome in regard to the National Building and Construction Industry Award. If ....., that award is seen as the parent award for this award and that they are closely aligned.

Again there is another issue in regard to applications to vary the award. In regard to the Roof Slaters and Tilers the less variation for the 2000 safety net adjustment I think was effective from September last year. We will be making application in the next week or so to vary this award for both the safety net adjustment and the expense-related allowances and again we would be hopeful that we could have that matter joined with the simplification so that we can have one new award made without the need for separate draft orders. I should explain that in this award I think there is about five pages of piecework rates.

THE SENIOR DEPUTY PRESIDENT: I remember it when it was the State award.

MR MAXWELL: It would be much preferable just to have a finalised award rather than have separate draft orders made. So at this stage we would be making application in the next week and we will with the application write to Vice President Ross and indicate that we would seek to have that matter joined with the simplification. So whether we have a report back at the same time as the mobile crane and see how far we have got by then. That may be appropriate at this stage. If the Commission pleases.

MR SHERMAN: Yes, your Honour. I think it would appropriate to have the report back say late August sometimes. I think then we will be in a position to see if there are any matters of contention between the parties, if any.

THE SENIOR DEPUTY PRESIDENT: Would 10.30 on 29 August suit on the basis that half an hour for the earlier matter should be sufficient?

MR MAXWELL: Yes.

THE SENIOR DEPUTY PRESIDENT: I will adjourn this matter until 10.30 on Wednesday, 29 August in Sydney for further report and I note the comment from Mr Maxwell that it is anticipated that applications to vary the award in relation to safety net and expense-related allowances will be filed next week with an indication to the head of the panel, Vice President Ross, that those applications could well be dealt with in connection with the matters before me. I will also raise that matter with Vice President Ross. The matter is adjourned on that basis.
