THE SENIOR DEPUTY PRESIDENT: I have had the opportunity to peruse the document. I would first of all take this opportunity to congratulate the parties on reaching this agreement. I am aware that a great deal of work goes into this process and it requires a degree of commitment to work your way through the exercise so you can achieve agreement and I believe both the employer and the employees need to be congratulated in that regard.

I have looked at the document from the perspective of the various tests outlined in section 170 of the Act. I am satisfied that it meets the requirement that trade unions were an option open to employees had they wanted a trade union to be involved in representing them. I am satisfied that the agreement was endorsed by a valid majority and that the necessary explanation to the agreement occurred to proceed the vote on the part of the employees to accept or adopt the agreement.

I am also satisfied that the agreement contains the necessary dispute avoidance procedures and is an agreement that is proposed to operate for a period envisaged by the Act. I have noted that exhibit A1, being the letter from Mr Huis, outlines a current salary classification structure and on the clear understanding from the parties that this salary classification structure can be appropriately used to replace that which is contained in appendix 1 of the document submitted to the Commission for certification then I do so replace it and on that basis I will certify the agreement as of today's date. A certificate will be issued in due course and will be forwarded to the parties. Again, I congratulate you and sincerely hope you will not need that dispute resolution provision contained in your agreement.
