THE SENIOR DEPUTY PRESIDENT: Mr Kane, I have discussed the situation with Mr Mills and Ms O'Leary. I have been unsuccessful in gaining their consent to any of my propositions. In the circumstances and having paid attention to the over-all situation I have decided to make a determination which is to the following effect.

The proper determination to this dispute is a payment of 40 per cent of that to which employees at Canon would otherwise receive for what is called the celebration bonus for the year 2000. I have decided this because of a lack of communication of the criteria which specifically withheld the bonus from those who had received a written warning for conduct in 2000. That criteria was reasonable. Were it not for the letter of 22 December 2000 which did not refer to the criteria I would have refused to make any determination in favour of the individuals who failed the criteria.

I would ask that this piece of transcript be prepared in summary form and distributed to the parties. I adjourn the Commission indefinitely.
