MR K. SINGER: Commissioner, I represent and appear for Thin Seam Mining Pty Limited.

THE COMMISSIONER: Thank you. Yes, Ms Doust?

MS DOUST: Commissioner, this is an application for certification of a Greenfields Agreement pursuant to section 170LL of the Act. You should have on the file the statutory declarations made by Mr Graham White from the CFMEU and also from Mr Earl Cook from Thin Seam Mining Pty Limited. We ask that the Commission certify the Gibson's Colliery Certified Agreement, July 2001.

THE COMMISSIONER: Do you have anything to say, Mr Singer?

MR SINGER: No, Commissioner.

THE COMMISSIONER: All right; thank you. This is an application under section 170LL of the Act for the certification of an agreement to which Thin Seam Mining Pty Limited and the Construction, Forest, Mining and Energy Union are parties. Having read the agreement and having examined the supporting documentation and in light of the submissions this morning I'm satisfied that the application meets the requirements of the relevant section of the Act and the rules and accordingly I certify the agreement.

The agreement will be known as the Gibson's Colliery Certified Agreement, July 2001. The agreement will come into force from today's date and it will remain in force for a period of three years. I'll issue a certificate to that effect and place it on the file. These positions are adjourned accordingly.
