THE SENIOR DEPUTY PRESIDENT: This matter is C2001/39. It is a section 113 application to vary the Victorian Catholic Schools and Catholic Education Offices Award 1998. The matter was last before me on 27 April 2001. I have come to a decision in the matter, and the decision is as follows. That having regard to the submissions that have been put to me in the matter and the material contained on the file in this matter, I am satisfied I should vary the Victorian Catholic Schools and Catholic Education Offices Award 1998, as sought in this matter.

I am satisfied that to do so would be consistent with the requirements of the Act, the regulations and the relevant statement of principles. The variation to the award will come into force from the first full pay period to commence on or after 27 April 2001 and shall remain in force for a period of 12 months. To the extent necessary, I am satisfied there are exceptional reasons and circumstances for granting that operative date. A copy of the order in the matter will be made available to the parties. I will adjourn now.
