MR C. LANE: I appear with MR DAVID ELLIOTT on behalf of the Australian Education Union in both matters.

THE D.PRESIDENT: Thank you. Mr Lane?

MR LANE: Thank you. The two agreements that have already been pointed out, one is to do with the Teaching Service (Tasmanian Public Sector) Salaries and Conditions of Employment Agreement 2000 and I will deal with that one first, if I may? That particular agreement has within it clause 6 dealing with salaries and classifications and provides for annual adjustments to salaries based on the average of salaries in other States and Territories in the public education systems. That exercise has been completed and you will see we have on the application, schedule 2A, lists the interstate salaries on which a calculation is based and schedule 1A of the amended agreement shows the new salary levels as a result of those changes.

It was decided after discussions with your office that in fact the best way to deal with this matter was simply to insert in the current agreement two new schedules. We have a schedule 1 and a schedule 2 for last year's figures and so we simply seek to have added to the agreement a new schedule 1A and a schedule 2A which will show this year's figures.

THE D.PRESIDENT: I think it was agreed that it is the implementation of what could be called a formula that was part of the agreement?

MR LANE: Yes.

THE D.PRESIDENT: Yes.

MR LANE: Yes, that is correct, and as I pointed out in the attachment we do not believe a vote of the employees is necessary as they already voted on the agreement which had within it very clearly the formula and so I do not believe there is much more I can really say on that particular agreement.

THE D.PRESIDENT: The only comment I would make is that my schedules are known as A1 and B1.

MR LANE: I thought that was for the TAFE agreement.

THE D.PRESIDENT: Oh, I see, they have got different ones, have they?

MR LANE: Yes, unfortunately we - in the school's one we had schedule 1 and 2, in the TAFE agreement it was schedule A and B.

THE D.PRESIDENT: All right. All right, I concede. It is 1A and 2A and A1 and - - -

THE D.PRESIDENT: B1 and B2 anyway. all right, thank you.

MR LANE: The explanation for the other agreement is exactly the same with again clause 6 allowing for annual adjustment based on a particular formula with the interstate salaries. They are mentioned in B1 and A1 has the list of salaries as of March 1 this year, if the Commission pleases.

THE D.PRESIDENT: Okay, and there will be a similar exercise around about this time next year to implement the formula again.

MR LANE: That is correct. Certainly.

MR PAYNE: If the Commission pleases we - the documentation reflects the original agreement between the parties and we ask that the agreement be amended as requested. Thank you.

THE D.PRESIDENT: Thank you. The operative date, if we make it from today, that fits in with the pay period, does it?

MR PAYNE: The operative date is from the firs pay period to commence on or after 1 March, which is 1 March, yes.

THE D.PRESIDENT: All right, the firs pay period. Okay. these are applications by consent to vary in the first instance the Tasmanian TAFE Teachers Salaries and Conditions of Employment Agreement 2000; the second agreement is the Teaching Service (Tasmania Public Sector) Salaries and Conditions of Employment Agreement 2000. The applications vary the agreements to increase the pay rates in accord with the formula that was part of the agreement. Accordingly both of those agreements will be varied and those variations will take effect from the first pay period on or after 1 March 2001. Thank you. Those matters are adjourned.
