THE DEPUTY PRESIDENT: Could I just advise you that we have faxes from the ASU, CFMEU and the Clothing Footwear Union saying that they will not be in attendance but they have no objection to the agreement being certified in their absence.

MR M. WATSON: Thank you, Deputy President. First of all I do appear today on behalf of Sheridan Australia because they have actually asked me to come along so that is why I am here. Deputy President, the agreement passes the no disadvantage test as per the statutory declarations that you would have from all unions parties to the agreement and the employer. The agreement was approved by a majority via workplace ballot and the details of that are contained within the agreement. There is a dispute settling procedure at clause 27 and the expiry date of the agreement is 18 July 2004 which is contained at clause 5 and we would ask that the agreement be approved.

THE DEPUTY PRESIDENT: Okay, thank you. I have been through the agreement which is why the parties do not need to attend unless they particularly want to and I have no questions that I needed to ask. Accordingly the agreement will be certified pursuant to section 170LJ of the Workplace Relations Act. The agreement will be known as the Sheridan Australia Hobart Enterprise Agreement 2001 and the parties to the agreement are the TCFUA, the CFMEU, the AMWU and the ASU, Sheridan Australia Pty Limited and its employees.

The parties have provided the required statutory declarations and I am satisfied have met the requirements of the Act. The agreement will be certified, an order will issue to take effect from today's date and the agreement remains in force until 17 July 2004. I note that the agreement came into effect from 18 July 2001. That agreement is hereby certified.
