THE SENIOR DEPUTY PRESIDENT: Good morning to each of you. The matter has been listed for some time for report, so I'll go straight to you, Mr Ginters, and ask what the position is?

MR GINTERS: Good morning, and thank you, your Honour, for listing this matter this morning. Your Honour, can I say this? There were endeavours made to have a conference between the parties on Wednesday and for a number of reasons that didn't take place. I understand Mr Hill contacted my instructing solicitor and was attempting to set a conference subsequently on the Thursday but, again, due to unavailability of persons that wasn't able to occur. In those circumstances it appears that there's at least a willingness for the parties to discuss this matter on a further occasion, and what I would be inviting the Commission or asking the Commission to do is chair that conference at a time that's convenient to the Commission because I just think the assistance of the Commission with perhaps a final attempt to reach some resolution in this matter would be of enormous assistance to both parties.

MR HILL: The bank, your Honour, wouldn't oppose that, we're quite happy to talk and have the Commission involved, so we wouldn't oppose that.

THE SENIOR DEPUTY PRESIDENT: Very well. I suppose what we should do is try and arrange it. Just bear with me while I get the person who controls my bookings.

MR GINTERS: Thank you, your Honour. How long?

MR HILL: I would expect not less than an hour but probably not too much than an hour, your Honour. If your Honour isn't able to assist within the hour it probably won't be an exercise that would need to occupy your Honour's mind for much longer than that.

THE SENIOR DEPUTY PRESIDENT: I don't know what Mr Hill thinks, but that strikes me as being accurate, Mr Ginters.

MR GINTERS: Yes, that sounds pretty reasonable, your Honour.

THE SENIOR DEPUTY PRESIDENT: All right, then, well, we'll need an hour. When do you want it?

MR GINTERS: I can indicate, your Honour, next week is suitable for me.
