Industry and CEPU for certification of the
B.J. Banks Electrical Pty Limited Enterprise
Agreement 2001

MR M. WATSON: Appearing for B.J. Banks Electrical.

THE DEPUTY PRESIDENT: This is another solo performance.

MR WATSON: Yes, I was not going to attend this one specifically but seeing as I am here I guess I might as well appear.

THE DEPUTY PRESIDENT: Yes, okay. The CEPU have advised that they will not be attending but they consent to the application proceeding.

MR WATSON: Sure.

THE DEPUTY PRESIDENT: So if you want to speak to the agreement?

MR WATSON: Not necessarily, Deputy President. This agreement actually does come from some negotiations that were held with the National Electrical and Communications Association last year. There was a similar agreement registered for Russell Smith Pty Limited, certified by yourself earlier this year. This agreement is similar to that agreement. Obviously it passed the no-disadvantage test. The agreement was approved by a valid majority of the workplace on 13 September. It contains a grievance procedure through the relationship to award clause and the expiry date is 31.7.03 and we would ask that the agreement be approved. If it pleases.

THE DEPUTY PRESIDENT: All right, thank you. I have checked this agreement and there are no queries that I wish to raise with the parties. Accordingly the union is not in attendance but agrees to its certification. It is an application pursuant to section 170LJ for certification of the B.J. Banks Electrical Pty Limited Certified Agreement 2001. The parties will be B.J. Banks Electrical Pty Limited, its employees and the CEPU. The parties have complied with the requirements of the Act and have provided the necessary statutory declaration. Accordingly the agreement will be certified and will come into effect from the first full pay period on or after today and remain in force until 31 July 2003. That agreement is certified, thank you.
