THE SENIOR DEPUTY PRESIDENT: This is an application by Alinta Gas Limited and Another for an order under section 127 of the Workplace Relations Act to stop or prevent industrial action and the order was to be directed to the CEPU and the ASU for alleged industrial action. I understand from previous proceedings that the parties intend that this matter should be discontinued. Mr Noonan, do you appear on behalf of Alinta Gas in that matter?

MR NOONAN: I do, your Honour, and on behalf of Alinta Gas I would ask that the matter be discontinued.

THE SENIOR DEPUTY PRESIDENT: Thank you. Mr O'Byrne, do you agree the matter is to be - - -

MR O'BYRNE: Yes. I appear on behalf of the CEPU and I agree to the discontinuance of that matter, thank you, sir.

THE SENIOR DEPUTY PRESIDENT: Yes. Mr Kane?

MR KANE: Yes. On behalf of the Australian Services Union we are happy for that matter to be discontinued.

THE SENIOR DEPUTY PRESIDENT: Yes. Thank you. Very well, I will order that that matter, C2001/3859, be discontinued. Could I take this opportunity, Mr Noonan, Mr O'Byrne and Mr Kane, to congratulate you too on the achievement that has been reached by the parties. I think it has been a fairly long process but nonetheless productive in the end and I congratulate the parties on their efforts. Thank you. The matter is adjourned.
