MR RICH: Your Honour, on the last occasion we were before you we indicated that a further log of claims had been served on both IBMGSA and EDS. In light of that CPSU doesn't seek to further push the log of claims that have been served in the two matters that were before you today. In relation to those other logs of claims which have been served but in relation to which there has been no dispute notified as yet we will be notified of the dispute later on in the week once the time period for acceptance of the demands and those logs of claims has expired and on that basis there isn't very much before your Honour any longer.

THE SENIOR DEPUTY PRESIDENT: That just cleared my diary for me. The matters before Commissioner Smith, they are not listed this morning but they are now in my chambers, are they in the same position?

MR RICH: Well, as I understood - my friend could talk about that.

MR DOUGLAS: That matter will continue to be pressed. I understand that there have been no directions in that matter as yet.

THE SENIOR DEPUTY PRESIDENT: Well, Commissioner Smith made some, didn't he?

MR DOUGLAS: Yes, he did but we haven't complied with those your Honour. We have presumed that there would be a new set of directions because of the joinder of that matter with the log that has now not being proceeded with.

THE SENIOR DEPUTY PRESIDENT: Mr Rich, do you anticipate that the log has been served but there has been no dispute lodged in relation to it, do you think that that is a matter that you would seek to have heard with the matter that was before Commissioner Smith or separate.

MR RICH: There would be some efficiency to hearing the matters together given that issues of eligibility would be the same in botH.

THE SENIOR DEPUTY PRESIDENT: That would have the same problem in relation to Mr Dixon and Mr Douglas and his clients.

MR RICH: That's right.

THE SENIOR DEPUTY PRESIDENT: Well, perhaps when you do notify that dispute you could notify my chambers so we don't get into a situation again with two members having files where similar issues need to be dealt with. We have a change of panel head at the moment and Boulton J is the panel head, but I think that we can deal with it easily enough if you notify my chambers so that I can notify Boulton Js chambers. Is there any other matter.
