THE COMMISSIONER: I've conferred with the parties privately since going off the record. The Commission has indicated that in terms of its view of the deferred public holidays provision in clause 13 subclauses (13) and (14), that there is no entitlement for afternoon shift employees, on the basis that the clause crucially, whilst it talks about any employee who applies for leave for the purpose of attending the Labour Day march will be granted if they attend the march, and then the other qualifications in (i) and (ii) are addressed. Clearly, afternoon shift employees are at liberty to attend the march.

As I understand it, they would not start work until 3 pm that day, whereas I understand the march runs between 9.30 am approximately for something up to one hour. In terms of any problems with respect to day shift employees, the company will raise any difficulties of an operational nature they may have with the union by Friday, the 20th of this month, and I would trust that the provisions of the clause as worded would be applied and that there wouldn't be any further difficulties. If there are, either party is at liberty to seek to have the matter relisted.
