THE SENIOR DEPUTY PRESIDENT: Yes, Mr Thomson, you appear for the union in this matter?

MR G. THOMSON: Yes; another great pleasure, your Honour.

THE SENIOR DEPUTY PRESIDENT: Thank you. And I note that the Westpac Bank has appeared in the course of proceedings before me on Christmas Island. Those appearances have been by way of telephone conferences and Westpac Bank has participated in the safety net adjustment - sorry, the award simplification process. As a result of those discussions the parties have reached an agreement about the variations that are necessary to comply or conform with the requirements of item 51 and section 89A of the Workplace Relations Act.

Are there any other matters, Mr Thomson, that need to be considered in relation to this matter at the moment?

MR THOMSON: No, thank you, your Honour.

THE SENIOR DEPUTY PRESIDENT: And do you agree with me that the parties have reached an agreement on the variations that were required to comply with the requirements of item 51?

MR THOMSON: Yes, I do, your Honour, and those amendments have been recorded by yourself. Thank you.

THE SENIOR DEPUTY PRESIDENT: Very well. Just bear with me a moment, please. In this matter I was required to conduct a review of the Christmas Island Westpac Banking Corporation Award 1993. In the course of the proceedings before me on Christmas Island Mr Gordon Thomson has appeared for the Union of Christmas Island Workers that is the union. Mr Paul Fletcher has appeared by way of telephone conferences for the Westpac Banking Corporation. Mr Fletcher has sent an apology on the basis that he is on annual leave and not available for the conference today - sorry, the hearing today.

However, he did indicate to me his concurrence with the changes that are necessary to properly reflect the requirements of item 51 of the WROLA Act and section 89A of the Workplace Relations Act. Having heard Mr Thomson on the matter and Mr Paul Fletcher, I am satisfied that the changes in the award reflect the requirements of item 51 and section 89A. I am also satisfied that the award reflects the properly-fixed minimum terms and conditions of employment and on that basis I propose to issue an order effective or operative from today's date and in due course I will issue my reasons or publish my reasons for decision setting out in more detail the necessary changes and variations to the award to conform with the requirements of item 51 and section 89A. Anything else, Mr Thomson?
