MR D. DANIELS: I am from Symphony Australia Holdings Pty Limited appearing for Tasmanian Symphony Orchestra Pty Limited.

MR M. FORTESCUE: I am the musicians representative from the Tasmanian Symphony Orchestra.

THE DEPUTY PRESIDENT: Thank you. Can I tell you that I have been through the agreement and I don't have any questions that I need to ask you other than to interrogate Mr Fortescue as to his understanding of the agreement and he is satisfied that all of the other parties to the agreement understand its content.

THE DEPUTY PRESIDENT: There was no duress or intimidation.

THE DEPUTY PRESIDENT: Excellent.

MR FORTESCUE: Everyone has been consulted appropriately.

THE DEPUTY PRESIDENT: Stupid questions, but I have to ask them.

THE DEPUTY PRESIDENT: Thank you. Did you want to speak to the agreement at all?

MR DANIELS: No, Commissioner.

THE DEPUTY PRESIDENT: Not if you don't have to. All right. This is an application pursuant to section 170LK of the Workplace Relations Act for certification of the Tasmanian Symphony Orchestra Certified Agreement 2002. The parties to the agreement are the Tasmanian Symphony Orchestra and the musicians and players covered by the classifications found therein. The parties have provided the necessary statutory declarations and have complied with the requirements of the Act. I am satisfied that the employees have entered into the agreement freely and understand its contents. The agreement comes into effect from today's date and remains in force until 1 March 2004. Signed copies will be available in a couple of minutes. Thank you.
