TRANSCRIPT OF PROCEEDINGS
AUSTRALIAN INDUSTRIAL
RELATIONS COMMISSION
SENIOR DEPUTY PRESIDENT LACY
C2002/4598
APPLICATION FOR AN AWARD
Application pursuant to section 111(1)(b)
of the Act by Union of Christmas Island
Workers re roping-in award
CHRISTMAS ISLAND
3.15 PM, THURSDAY, 12 SEPTEMBER 2002
PN1
SENIOR DEPUTY PRESIDENT LACY: Yes, Mr Thomson, you appear for UCIW?
PN2
MR THOMSON: Yes, I do, sir, thank you, your Honour.
PN3
SENIOR DEPUTY PRESIDENT LACY: Thank you. And Mr McGovern, you appear for - sorry, I just need to locate the name of the - - -
PN4
MR McGOVERN: Christmas Island Idaroom.
PN5
SENIOR DEPUTY PRESIDENT LACY: Yes. Sorry, yes, Idaroom trading as Christmas Island Enterprises Pty Ltd. Thank you. Look you were both present during the course of the hearing in the last matter and both present during the course of the conference that proceeded there. I appreciate that what I have before me is an application for an award by consent, but in the circumstances I think it probably wise to adjourn this matter until March 2003, so that it may then be dealt with at the same time as the award simplification matter in that UCIW Christmas Island Infrastructure, Rebuilding (Mainland & Domiciled) Employees Award.
PN6
There really would be no purpose in making a roping-in order at the moment because the roping-in order would have to say something to the effect that the award applies in so far as it includes allowable matters and given what we have discussed earlier today about clause 12 of that award, we don't really know what are allowable matters and what are not allowable matters. So, Mr Thomson, would you have any objection to that course, that this matter be adjourned to March 2003?
PN7
MR THOMSON: No, your Honour, I would not have any objection to that.
PN8
SENIOR DEPUTY PRESIDENT LACY: Yes, thank you. Mr McGovern, are you - - -
PN9
MR McGOVERN: No, no, I don't. That is fine.
PN10
SENIOR DEPUTY PRESIDENT LACY: Yes, thank you. Well, look, thank you for both attending and again, Mr McGovern, thank you for being so patient and being here for the other matters, but it is probably as well that you were because you now have a fair understanding or knowledge of what is happening with the award. Thank you. The matter is adjourned.
ADJOURNED INDEFINITELY [3.21pm]
