MR J. HOWARD: I appear for Portolesi Nominees Proprietary Limited. I am here this morning representing the company, Commissioner, seeking an adjournment of this matter for approximately 2 weeks. The reason behind the adjournment is that this morning Mr Portolesi received a phone call from Mr Harris of the CFMEU requesting that they hold a discussion in respect to this particular agreement. My instructions are from Mr Portolesi to seek an adjournment because he has agreed to meet Mr Harris on Monday week to discuss the agreement.

I would like to hand up at this point in time the notices that were issued to each and every one of the employees so the Commission is aware that the proper procedure was followed in respect to notify employees of the company's intent to enter into an enterprise bargaining agreement with each and every one of the employees concerned. On that I have no further submissions. Thank you, Commissioner.

THE COMMISSIONER: I take it these employees are still the same five?

MR HOWARD: They are still the same employees concerned. It is a small family business, Commissioner, that actually does caulking within the larger and smaller areas of the construction industry. They have agreed to meet with the union and discuss the situation. Therefore I request an adjournment for approximately 2 weeks.

THE COMMISSIONER: Well, what we will do is adjourn it to a date to be determined just in case some other issue arises and it will give you the opportunity to bring it on when you are able to do so.
