THE SENIOR DEPUTY PRESIDENT: Yes, Ms Jastrzebski?

MS JASTRZEBSKI: Commissioner, this is an application to certify an agreement between Hunt Boilers and the AMWU. The agreement was made to avoid an industrial situation - from giving rise to an industrial dispute. The agreement was approved by a valid majority of employees. It contains procedures for the prevention and settlement of disputes. It has a nominal expiry date and we would rely on our statutory declaration to prove that the requirements of the Act have been met. And we ask that this be certified. If the Commission pleases.

THE SENIOR DEPUTY PRESIDENT: Yes. Well, having regard to the material contained on the file in this matter - this is out of time Ms Jastrzebski. Is there any particular reason for that?

MS JASTRZEBSKI: I don't actually have a copy of the file with me, but I do know that it came to the office during a period of some internal trouble, and the mail, basically - well, it just piled up in the national office for about five, six weeks. And when the mail was released we dealt with things as quickly as we could. But the site - Linda Pope was the organiser responsible for that, nd she assures me that there has been no significant change to the workforce, and that they are actually - are still very - their attitude is very positive to the agreement.

THE SENIOR DEPUTY PRESIDENT: Thank you. I am satisfied I should grant the necessary extension of time for the lodgment of that application in this matter.

MS JASTRZEBSKI: Thank you, your Honour.

THE SENIOR DEPUTY PRESIDENT: I am also satisfied, having regard to the material before me in the submissions that I should certify the agreement known as the Hunt Boilers BHP Steel Westernport Certified Agreement 2000/2003. I am satisfied that to do so would be consistent with the requirements of the Act and the regulations. The certification of the agreement will come into force from today's date and remain in force until 31 March in the year 2003.
