THE SENIOR DEPUTY PRESIDENT: The next matter is AG2002/4652. It is an application by the AMWU in respect of Lifting Victoria Certified Geelong Area Agreement 2000.

MS R. JASTRZEBSKI: I appear for the Australian Manufacturing Workers Union.

THE SENIOR DEPUTY PRESIDENT: Yes, Ms Jastrzebski.

MS JASTRZEBSKI: Your Honour, this is an agreement between a company called Lifting Victoria and the AMWU, and it would apply to the work in the lift industry that the company does in the Geelong area. The agreement was made to avoid an industrial situation giving rise to an industrial dispute. It is underpinned by an appropriate award. It has a nominal expiry date. It contains procedures for the prevention and settlement of disputes. And it was approved by a valid majority of employees. And we believe that the requirements of the Act have been met and ask that this be certified, if the Commission pleases.

THE SENIOR DEPUTY PRESIDENT: Again, it is out of time, Ms Jastrzebski.

MS JASTRZEBSKI: Your Honour, this agreement, like many others, was held up because of the internal difficulties that we were having at the union. And Gary Rob is the organiser for the Geelong area, and he has caught up with the representative of the employees, and they are still supporting of the agreement, and the numbers haven't changed.

THE SENIOR DEPUTY PRESIDENT: Yes. Well, having regard to the material contained on the file in this matter, and also the submissions put to me, I am satisfied I should grant the necessary extension of time for the lodgment of the application in this matter. And I am also satisfied I should certify the agreement known as the Lifting Victoria Certified Geelong Area Agreement 2000, and I am satisfied that to do so would be consistent with the requirements of the Act and the regulations. The certification of the agreement will come into force from today's date and remain in force until 31 March in the year 2003. Thank you.
