MR D. NUNNS: I appear on behalf of the AMWU.

THE SENIOR DEPUTY PRESIDENT: I have received correspondence from the Boyded indicating they are unable to be here today. They rely on their statutory declaration and request that the Commission certify the agreement.

MR NUNNS: Yes, that is correct, Commissioner. Just in relation to this matter, Senior Deputy President, the parties have lodged supporting statutory declarations consistent with the Workplace Relations Act and particularly in respect to division 2 of part VIB of the Act. We submit that the requirements specified in section 170LT of the Act for the certification have been complied with and the agreement was filed on time. As you have indicated, the company do support the certification and are relying upon their stat decs and we respectfully submit that the agreement be certified effective from today's date.

THE SENIOR DEPUTY PRESIDENT: Well having regard to the material contained on the file in this matter and also the submissions put to me, I am satisfied I should certify the agreement known as the Boyded Auburn Enterprise Bargaining Agreement 2001. I am satisfied that to do so would be consistent with the requirements of the Act and the regulations. The certification of the agreement will come into force from today's date and remain in force until 31 October in the year 2003.
