THE SENIOR DEPUTY PRESIDENT: Thank you. It is essentially the same process as the last matter other than the relevant award is the - now simplified, Airline Operations Salaried Staff (Ansett Australia) Award 1998. The relevant roping-in award in this case is the Salaried Staff (Ansett Airline) (Roping-in No. 1) Award 1992 which bound Southern Cross Airlines Holdings Limited in respect to employees within the scope of the predecessor general award, the 1990 award and correspondence was sent to the ASU and Southern Cross Airlines. No response has been received from the airlines so I am in your hands, Ms White, as to what do you think would be the appropriate action in respect to this matter.

THE SENIOR DEPUTY PRESIDENT: Our preferred position in this matter is also to keep - to have them as respondent until we can ascertain whether the administration is finalised. Again, our view is it has been active recently and we want a confirmation from the administrators that it is wound up and we haven't got that as yet.

THE SENIOR DEPUTY PRESIDENT: Yes, very well. Well, I will deal with it in the same way as the other matter. I will set aside the roping-in award but with effect from the same date today. I will vary the simplified award to add as a respondent, Southern Cross Airlines Holdings Limited again on the basis that at some point in time if you think there is no continuing utility in their respondency, you can make application to delete them and indeed I guess to the extent that Ansett Australia - Ansett Airlines Award issues might arise as to the utility of the award as a whole.
