MS S. BELLINO: May it please the Commission, I appear on behalf of the Australian Liquor Hospitality Miscellaneous Workers Union.

MR D. MILLS: May it please the Commission, I appear on behalf of Qantas Airways Limited in this matter.

THE COMMISSIONER: Yes, thank you. I've looked at the documents, the statutory declarations and the agreement. I see what is before me and I am relatively satisfied or I am satisfied but is there anything in particular that you wish to draw to my attention, Mr Mills or Ms Bellino?

MR MILLS: Not really, Commissioner, other than this is an application that we say is made under division 2 of part VIB of the Act. It is made in accordance with the provisions of the Act and I think the statutory declarations significantly cover off what's required for the matter to be certified.

MS BELLINO: Commissioner, we concur with those statements and request that the agreement be certified, may it please the Commission.

THE COMMISSIONER: Yes, thank you. This is an application to have an agreement made and that agreement is to be known as the ETOMS ALHMWU (Qantas Airways Limited) Enterprise Agreement VI or 6. The parties to the agreement are Qantas and the LHMU, for short. On the basis of the submissions and the documentation the Commission is satisfied the relevant requirements of the Act and that the rules of the Commission have been complied with. Consequently the agreement will be certified. It will come into force from 5 December 2002 and remain in force until 30 June 2004. On that basis, these proceedings are now adjourned. Thank you.
