TRANSCRIPT OF PROCEEDINGS
O/N VT02920
AUSTRALIAN INDUSTRIAL
RELATIONS COMMISSION
SENIOR DEPUTY PRESIDENT LACY
C2001/6183
AUSTRALIAN MUNICIPAL, ADMINISTRATIVE,
CLERICAL AND SERVICES UNION
and
C & M AQUATICS
Notification pursuant to Section 99 of the Act
of a dispute re pay and conditions of employment
MELBOURNE
10.22 AM, FRIDAY, 8 MARCH 2002
Continued from 13.12.01
PN45
THE SENIOR DEPUTY PRESIDENT: Mr Harvey.
PN46
MR HARVEY: Yes, your Honour. I think essentially we are in exactly the same position on this. C & M Aquatics, unless I am completely wrong, is one of Mr Eberhard's members and they have been involved in the discussion. So we would put these two matters really in the same boat at the moment and the outcome in the matter we have just been reporting on will undoubtedly be the outcome with regard to this as well. So the report on this is that, as I said, we have had discussions with VECCI representing C & M Aquatics and their intention at the moment is to be part of any industry-wide outcome. So we would ask for this matter to be listed again for report back at the same time as the roping-in application. If the Commission pleases.
PN47
THE SENIOR DEPUTY PRESIDENT: Thank you. Do you agree with that, Mr Eberhard?
PN48
MR EBERHARD: I do. The only thing I would say, your Honour, is that it might well be more convenient if the two matters that have been listed today actually be joined in the sense of - rather than having separate report backs because C & M Aquatics have been participating as one of the four companies that we have referred to in the previous hearing and it may well just make for ease of convenience that those two matters are joined together and that, therefore, we don't have to go through a separate hearing in respect to C & M Aquatics because I would submit at this stage, without really going through a process of looking at it or - that their position will more than likely be the same as the three others that VECCI represents and we would be putting on a unified voice in respect to the four companies rather than the three plus another one in the different matter. So I think it may well just be easier and for convenience that the matters are joined together.
PN49
THE SENIOR DEPUTY PRESIDENT: Yes, all right. Thank you very much. You don't have any part to play in this, as I understand it, Ms Moore. Is that right?
PN50
MS MOORE: No, your Honour, I do not.
PN51
THE SENIOR DEPUTY PRESIDENT: Do you agree, Mr Harvey, that the matters can be joined and dealt with at the same time?
PN52
MR HARVEY: Yes, I think that is convenient, your Honour.
PN53
THE SENIOR DEPUTY PRESIDENT: I will direct that that matter be joined with matter C2001/5206 and that it too be listed on 19 April for report back. Anything else?
PN54
MR HARVEY: No, your Honour, thank you.
ADJOURNED UNTIL FRIDAY, 19 APRIL 2002 [10.25am]
