MR C. WINTER: I appear on behalf of the Australian Workers Union. With me is the delegates.

MS L. MUMME: I seek leave to appear on behalf of the Moonee Valley Racing Club.

THE COMMISSIONER: Yes, Ms Mumme, leave is granted. Mr Winter.

MR WINTER: Thank you, Commissioner. This is an application made under 170LJ of the Act between the Australian Workers Union and Moonee Valley Racing Club. The agreement has been lodged late and I would ask the Commission to use its discretion under 111(1)(r) for similar reasons to the previous matter.

THE COMMISSIONER: Yes, leave is granted.

MR WINTER: The agreement has been negotiated by the consultative committee over a period of time. The agreement does contain a nominal expiry date, it contains a disputes procedure at clause 20 that gives the Commission right to both conciliate and arbitrate. I don't see any reason why the agreement cannot be certified as it complies with all aspects of the Act and therefore we would seek certification from today's date and unless the Commission has any questions in regard to the agreement, I have got nothing further.

MS MUMME: Commissioner, Moonee Valley supports the submissions put by Mr Winter this morning and seeks certification from today's date.

THE COMMISSIONER: Yes, thank you. Well, this is an application for an agreement to be certified between the Moonee Valley Racing Club and the Australian Workers Union, the agreement to be known as the Moonee Valley Racing Club and the Australian Workers Union Enterprise Agreement 2003. Pursuant to section 170LT of the Workplace Relations 1996 the Commission certifies the said agreement. The agreement comes into force from today's date, 14 March 2003 and remains in force until 30 June 2005. Thank you. The Commission is adjourned. Good morning.
