THE COMMISSIONER: I note that there are no changes to the appearances. This matter was last dealt with both on and off on the record on 28 February. The Commission at that time acknowledged the receipt of formal written submissions filed by the LHMU and by the ACTU. During conciliation, the parties conferred about the issues and implications arising from the union's application. The parties were urged to continue to confer directly on their respective agendas with wider representative bodies. Further conciliation was listed for today prior to the filing by the AHA of its formal submissions by 26 March.

I am commencing on the record today merely to give the parties an opportunity to make a record of any developments since we were last together prior to adjourning further into conciliation. Mr Swancott, are you able to - or is there something that you wish to place on the public record?

MR SWANCOTT: Very briefly, Commissioner, the LHMU has been in contact with the AHA on a number of occasions since we were last before you, and we have also used that period to consult further within our organisation, which included a video conference hook-up earlier this week of the branches that are relevantly involved in the application; that is the four states that are covered by the award. And as a result of that, I have further instructions and room to discuss a possible conciliated settlement of the matters. Thank you, Commissioner.

MS BERGMANN-HANNA: Thank you, Commissioner. The AHA notes it is still considering the contentions lodged by the LHMU and the ACTU. The issues raised by these applications are still being considered internally. We've had some further discussions with wider representative groups as referred to earlier but that I'm to speak briefly - just briefly say that's where we're up to at this moment. Thank you.
