THE DEPUTY PRESIDENT: This is an application pursuant to section 170LJ of the Workplace Relations Act for certification of the Pilkington (Australia) Operations Limited Tasmanian State Operations (Enterprise Bargaining Stage V) Agreement 2003. The parties to the agreement are the CFMEU, Pilkington Australia Limited and those employees covered by the classifications found therein. Each has provided the necessary statutory declarations and in that respect I am satisfied I have met the requirements of the Act.

Neither of the parties are in attendance, having been informed there were no queries in respect to the agreement, and each has provided a fax seeking the agreement be certified in their absence. However, there is one query, which is not a query it is a comment, and that is appendix 8: Labour Hire Contractors, whether that can be enforced or not is another thing. Although at this stage I am not aware that it is a non-allowable or an obnoxious matter under section 298Z of the Act but that is there for the record.

An order will issue to take effect from today's date and remain in force for a period of three years. That agreement is hereby certified. Thank you everybody. Come again.
