MS J. McAULIFFE: I appear for Rail Infrastructure Corporation.

THE COMMISSIONER: We have had no call from Mr Marchionni as to a reason why he might not be present. Now, past the witching hour of 10 o'clock, what is the position, Ms McAuliffe.

MS McAULIFFE: I met with APESMA and Mr Marchionni on Thursday as part of the instruction from our last meeting here to go over the background of each evaluation, person by person and each direct appointment. On that meeting, he concluded to say he was satisfied with the outcome. As I don't have my college here, we went through this documentation and I was assured that he was satisfied.

THE COMMISSIONER: On that basis then, I will take you word for it and unless Mr Marchionni wishes to notifies us again to the contrary, I take it that the matter are now satisfied with their discussions and the matters are now settled and I intend to close the file within the next 5 days.
