MR B. SHAW: I seek leave to appear for the applicant.

MR P. McCRUDDEN: I seek leave to appear on behalf of the CEPU.

THE DEPUTY PRESIDENT: Any objection?

MR SHAW: I think we are going to be faced with a similar situation as we had earlier; hopefully it won't take as long. Pursuant to section 43(2) I make a similar objection as Mr Burchardt made in the previous matter to the appearance. The matter is an LK application. There was no involvement of the union at all in the negotiation process and certainly as far as is known there was no request made pursuant to section 170LK(4) for such involvement.

THE DEPUTY PRESIDENT: Thank you. Mr McCrudden.

MR McCRUDDEN: Commissioner, the union didn't serve a bargaining period on the company.

THE DEPUTY PRESIDENT: The objection is taken under section 43(2) of the Act.

MR McCRUDDEN: All I am looking for is that we get it set aside so I can speak to the members - or adjourned so I can speak to the members.

THE DEPUTY PRESIDENT: All right. Well, look, what I propose - thank you very much. Before we get into a detailed discussion of the Act and the authorities could I perhaps suggest that we have a short conference - emphasis on the word short - in an endeavour to see if we can reach settlement on this matter?

MR SHAW: I have no objection to that.

MR McCRUDDEN: No objection.

THE DEPUTY PRESIDENT: We will adjourn into conference.
