THE COMMISSIONER: The appearances are unchanged, for the record.

MR G. LEECH: The appearances are the same as before, Commissioner. Commissioner, the Corps seeks certification of the Corps of Commissionaires Special Sites Workplace Agreement - 2003. To this end, Commissioner, I would like to tender copies of two letters sent to all employees.

EXHIBIT #A1 COPIES OF LETTERS SENT TO EMPLOYEES

MR LEECH: Commissioner, the first letter is a letter to all commissionaires, indicating their rights under the Workplace Relations Act 1996 in relation to representation of an organisation. The second letter, dated 21 February 2003, is a letter to all commissionaires, enclosing a copy of the proposed agreement. We submit that the requirements of the Act have been met and seek certification of the agreement.

THE COMMISSIONER: Thanks, Mr Leech. Mr Cleary, are you acquainted with the terms of the agreement?

MR D. CLEARY: I am, Commissioner.

THE COMMISSIONER: Do you agree with the terms of the agreement?

MR CLEARY: I do.

THE COMMISSIONER: Can you satisfy the Commission that the other members of the Corps of Commissionaires understand and agree with the agreement?

MR CLEARY: I can, indeed.

THE COMMISSIONER: Thanks very much, sir. As in the previous matter, the Commission is content that the agreement meets the terms and requirements of the Workplace Relations Act and, more importantly, meets the no disadvantage test. Accordingly, the agreement to be known as the Corps of Commissionaires Special Sites Workplace Agreement - 2003 meets the requirements of the Act. Therefore, pursuant to section 170LT of the Workplace Relations Act 1996, the Commission certifies the said agreement. The agreement shall come into force from 17 April 2003 and remain in force until 31 March 2006. The Commission is adjourned. Thank you.
