MR BREEN: Commissioner, I would like to submit this agreement to the Commission - - -

THE COMMISSIONER: Mr Breen, stand up.

MR BREEN: The agreement relates - - -

THE COMMISSIONER: Don't be nervous, I have never eaten anyone at this time of the morning in my life, perhaps after lunch some times.

MR BREEN: Well, we are lucky to get in in the morning then.

THE COMMISSIONER: That is right.

MR BREEN: The agreement relates to a single business which is Lynne Hoban Personnel Systems and in particular it relates solely to gate attendants who work at the Royal Melbourne Show. The MEAA is entitled to represent the interests of members at the Show. I submit that the agreement passes the no disadvantage test and was made in accordance with section 170LJ of the Workplace Relations Act. Commissioner, if I could just give a little bit of background. We are certifying this as a Greenfields agreement.

THE COMMISSIONER: Yes.

MR BREEN: However, there is a number of people who work at the Show year after year and who are members of the MEAA. We undertook some consultation in terms of speaking to staff last year about the fact that the agreement was coming up for renewal and we had some representations from people who have worked over a number of years - - -

THE COMMISSIONER: Yes, Mr Breen, the Commission is well aware of the itinerant nature of employees at the Royal Melbourne and other shows. There is no need to go into that much background.

MR BREEN: Right, okay. The agreement includes procedures for preventing and settling disputes under clause 17 and the agreement is for a period of three years.

THE COMMISSIONER: Yes, thank you very much. Mr Langford, do you have anything to say?

THE COMMISSIONER: Mr James.

THE COMMISSIONER: This agreement is to be known as the Hoban Recruitment Royal Melbourne Show Grounds Agreement 2003. It is an application pursuant to section 170LL, a Greenfields agreement. The Commission is satisfied the agreement meets the requirements of the Act and the rules of the Commission. Accordingly, pursuant to section 170LT of the Workplace Relations Act 1996, the Commission certifies the said agreement. The agreement comes into force from today's date, 1 May, and remains in force until 1 May 2006. The Commission is adjourned. Thank you.
