THE COMMISSIONER: The statement that I wish to make and record on transcript and which will be provided to the AMWU is as follows.

On the material before me, I accept the submissions of the AMWU that employees of Tyco Australia trading as Raymond Terrace Air Conditioning employed on the construction of the Kempsey Gaol project are entitled to be paid in accordance with appendix 2 of the Tyco Australia Pty Limited trading as Raymond Terrace Air Conditioning, Air Conditioning and Insulation On-Site Construction Enterprise Agreement for the Newcastle Region 2001-2002.

That is the end of the statement. As I said, it's a clear interpretation by the Commission as to employees entitlements. There should be no argument about it. If there is any continuing disputation, I will rely on Mr Morrison advising my associate and steps will then be taken to ensure that the company appears before the Commission.
