above award re the Safety Net Review -
Wages - May 2003 Decision

MR KENNEDY: Your Honour, this is an application to vary the award in accordance with the Safety Net Review - Wages - May 2003 Decision. Your Honour, a copy of the application of the variation, a notice of listing and a draft order have been served on the employers respondent to the award and an affidavit of service attesting to this in relation to each of these employers has been sworn by Greg Sword, General Secretary of the union. We would also note that the draft order that we are seeking is consistent with the decision and the principles outlined in that decision of 6 May 2003, namely the minimum weekly wage rates have been increased by $17; the required absorption clause has been included and we also give a commitment to those matters regarding absorption outlined in the principles of the Full Bench decision.

In addition, we have varied the allowances contained in the award in accordance with the established principles and those explanatory notes are also contained in this draft order. We are seeking that the order come into effect on the first full pay period to commence on or after 19 June 2003, which would constitute 12 months since this award was last varied for these matters. That is the extent of our submissions, your Honour.

THE VICE PRESIDENT: Thank you, Mr Kennedy. I am satisfied the application is consistent with the May 2003 Safety Net Review - Wages - Decision and I will issue an order in the form sought. The order will come into force on the first pay period to commence on or after 19 June 2003. I will adjourn that matter.
