MS H. RYALL: I appear for the Transport Workers' Union, with

MS J. TISDALE. This is an application to vary the Bread Sales Personnel (Australian Capital Territory) Award 1999. Copies of the application, draft order, and calculation schedule and hearing notice was sent by registered post to the award's respondents on 27 May 2003, and I have a statement of service here.

THE VICE PRESIDENT: Thank you.

MS RYALL: We have realised that there is one error in the draft order that was sent to you, and that appears at point 5 where it refers to deleting the amount of $53 appearing at clause 21.3.2 and 21.9.3 and inserting $56. That was left there in error, so that should be deleted from the draft order.

THE VICE PRESIDENT: Why?

MS RYALL: It is a supportive wage clause, which is actually - - -

THE VICE PRESIDENT: No, no, I appreciate that, but is there any reason - is the supportive wage currently $53?

MS RYALL: No, it has actually - - -

THE VICE PRESIDENT: I see, it is currently 56.

MS RYALL: - - - already been increased.

THE VICE PRESIDENT: Okay.

MS RYALL: Yes. The draft order includes the arbitrator safety net adjustment arising from the Safety Net Review Wages May 2003 decision. Work related allowances have been adjusted in accordance with principle 5 of the Commission's statement of principles, and expense related allowances have been adjusted by increasing them by the CPI since the time they were last adjusted. The union gives the commitment required by principle 8(d) as to the absorption of the safety net adjustment and we are seeking an operative date of 23 June.

THE VICE PRESIDENT: Okay, thank you. Well, the course I take in relation to this matter is to write to the three or four named employers, and provide them with a period until 4 pm on Friday, 20 June to advise me as to whether there is any opposition to the issuing of an order in the form sought. If there is no opposition then I will issue the order and it will operate from the first pay period on or after 23 June 2003.
