THE DEPUTY PRESIDENT: AG2003/5254, an application pursuant to section 170LJ of the Workplace Relations Act for certification of an agreement to be known as the Britton Brothers Pty Limited Enterprise Productivity Agreement 2003. The parties to the agreement are Britton Brothers Pty Limited, the CFMEU and employees covered by the classifications found in the agreement. Each of the parties has provided the necessary statutory declarations.

None are in attendance having been advised that the Commission has no queries in respect to the content of the agreement and accordingly each has agreed to certification in their absence. I am satisfied the parties have complied with the requirements of the Act and accordingly the agreement will be certified. An order will issue to take effect from today's date and to remain in force until 28 February 2005. I note however the agreement came into effect on 1 March, or the first pay period on or after 1 March 2003. That agreement is hereby certified.
